Visitors' Rules and Regulations
"Organizer" - Hong Kong Jewelry Manufacturers' Association
"Exhibition" - JMA Hong Kong, JMA Hong Kong International Jewelry Show
"Exhibition Venue" - Hong Kong Convention and Exhibition Centre
"Visitors" - any person who visits or attends the exhibition organized by Hong Kong Jewelry Manufacturers' Association
"Exhibitor" - a sole proprietor, a partnership or a limited company applying to exhibit at the Exhibition or, as the case may be, whose application to exhibit at the Exhibition has been accepted by the Organizer. For the purpose of doubt, "Exhibitor" shall include all employees' representatives and agents of such sole proprietor, partnership or limited company.
Please read the terms of use set forth below, as they apply to visitors' entry to JMA Hong Kong, JMA Hong Kong International Jewelry Show.
By registering for or attending the Exhibition, visitors are deemed to have fully read, understood, and agreed to comply with and be bound by these Rules and Regulations, and any additional or amended rules reasonably published or referenced by the Organizer within the Exhibition venue via notices, signage, electronic screens, written notices, the official website, or mobile applications.
Visitors do not have the Organizer's permission to attend, and may not attend, the Exhibition without confirming visitors' acceptance of these Rules and Regulations in writing prior to visitors' attendance.
The Organizer reserves the right, based on the maintenance of Exhibition order, security, protection of intellectual property rights, commercial interests, or other reasonable grounds (including, but not limited to, suspicion of unauthorized commercial activities, photography, recording, or disturbance of other visitors), to refuse entry to any person, to reclaim and/or invalidate any issued admission pass, or to adjust, restrict, or terminate a visitor's eligibility to attend the Exhibition, without prior notice, without providing reasons, and without any compensation.
The Organizer reserves the right to modify these Rules and Regulations, Exhibition times, venue arrangements, ticketing policies, etc., at any time. Modifications will take effect immediately upon publication, and visitors are responsible for regularly reviewing the latest terms. Visitors' continued attendance at the Exhibition following the publication of any modification shall constitute their acceptance of such modification.
Visitors must not engage in, and are not permitted to undertake, any activity that may cause or is likely to cause disturbance, nuisance, annoyance, inconvenience, disruption, obstruction to the conduct of the Exhibition, infringement of the rights of others, infringement of intellectual property rights, endangerment of public safety, risk of damage to exhibits or facilities, or violation of any laws, regulations, or ordinances applicable in the Hong Kong Special Administrative Region, or any action which, in the Organizer's opinion, does not conform to the general standards of the Exhibition or violates these Rules and Regulations.
If any visitor conduct breaches these Rules and Regulations or violates applicable laws or regulations, the Organizer reserves the right to take such measures as it deems necessary and appropriate, including but not limited to verbal warning, written warning, confiscation of relevant tools or items, cessation of activity, refusal of your entry to the venue or request for your immediate departure, prohibition from attending future events organized by the Organizer, reporting to the police, and pursuing relevant civil and criminal liabilities. Regarding the determination of such conduct and the choice of measures, the opinion and decision of the Organizer shall be final and binding.
The Organizer shall not be liable for any loss of or damage to any of visitors' property occurring in or about the Exhibition venue, or for the death of or any injury sustained by any visitor whilst in or about the Exhibition venue, other than for death or injury resulting from organizer's negligence or which otherwise cannot be excluded or restricted at law. Without limiting the generality of the foregoing, the Organizer shall have no liability whatsoever for: (a) any force majeure event, including but not limited to acts of God, pandemic, epidemic, government orders, venue closures, or any other circumstances beyond the Organizer's reasonable control; (b) any act or omission of any third party, including any Exhibitor, other visitor, or the Exhibition venue operator; (c) any contributory negligence or fault of the visitor; or (d) any indirect, consequential, special, or punitive damages, including loss of profits, loss of business, or loss of data, howsoever arising. To the maximum extent permitted by law, the Organizer's total aggregate liability to any visitor in connection with the Exhibition shall not exceed HKD 1,000 or the registration fee paid by the visitor (if any), whichever is lower.
Visitors agree that organizer shall not incur any liability to visitors for any goods or services offered or sold by, or representations made by, any Exhibitor at the Exhibition.
Visitors agree to indemnify and hold organizer harmless against any and all claims, demands, losses, liabilities, damages, proceedings, judgments, expenses and costs (including legal costs on a full indemnity basis) arising from or in connection with any act, omission, breach, or negligence of the visitor (including the visitor's employees, agents, and contractors) that causes or contributes to loss of or damage to the property, business, or reputation of the Organizer, other Exhibitors, other Visitors, or the operator of the Exhibition venue, including but not limited to damages arising from visitors' breach of these Rules and Regulations. This indemnity shall survive the termination or expiry of these Rules and Regulations.
Visitors agree that organizer shall not incur any liability to visitors for any error or omission in any information relating to any Exhibitor or its products in the Exhibition's official directory, website, mobile application, or in any other promotional or other printed materials or information provided by organizer or that Exhibitor.
Visitors represent and warrant that: (a) they are attending the Exhibition for lawful purposes only; (b) they will comply with all applicable Hong Kong laws and regulations; and (c) their attendance at the Exhibition will not infringe any third party's intellectual property rights or other rights. In the event of any breach of the foregoing representations and warranties, visitors shall indemnify the Organizer for all losses and costs (including legal costs) incurred by the Organizer as a result.
Visitors shall not record images in any form while attending the Exhibition without organizer's prior written consent. Such prohibition includes, but is not limited to, the taking of photographs, video or digital recording of any type and drawing or sketching of images. Visitors agree to surrender to organizer on demand whatever media on which images may be recorded in violation of this rule.
The copyright and other intellectual property or other rights (including for the avoidance of doubt, rights in sound recording and broadcasts) in materials created in violation of this clause 4, whether arising now or in the future, are hereby irrevocably assigned by visitors to the Organizer, and visitors agree to execute a formal written assignment instrument upon the Organizer's request, in compliance with section 194 of the Copyright Ordinance (Cap. 528). Pending execution of such formal assignment, visitors hereby grant to the Organizer an irrevocable, worldwide, royalty-free, sub-licensable licence to use such materials for any purpose. Visitors hereby waive all moral rights in such materials to the fullest extent permitted by law.
Visitors agree to indemnify and hold organizer harmless against all claims, liabilities, losses, proceedings, damages, judgments, expenses and costs (including legal costs on a full indemnity basis) incurred by or on behalf of or made against the Organizer arising out of or in connection with any infringement or other claim relating to the unauthorized making of any recordings by visitors.
Visitors acknowledge and agree that organizer may take photographs/videos which could include images of visitors while attending the Exhibition. Visitors hereby consent to and grant to organizer, the unrestricted, perpetual, worldwide, royalty-free and transferable right and license to use such images worldwide without any compensation, for any purpose including but not limited to Exhibition promotion, publicity, press, archival, and any other commercial purposes. Visitors acknowledge that the Organizer is the exclusive owner of all rights in such images and hereby waive (a) any and all moral rights in and to them to the fullest extent permitted by law, and (b) any and all claims visitors may have relating to or arising from organizer use of them. The collection and use of such images is subject to the Personal Data (Privacy) Ordinance (Cap. 486).

Visitors agree to the use and disclosure of visitors' information in the manner set out in organizer's Privacy Policy Statement http://www.jewelry.org.hk/en/privacy.php (as updated from time to time).
Visitors agree that the personal data may be used for processing registration, identity verification, on-site management, communication, security, data analysis, and lawful promotional purposes as deemed appropriate by the Organizer. Personal data may also be transferred to the Organizer's affiliates, business partners, sponsors, and service providers for purposes related to the Exhibition and future events. The Organizer will retain personal data for such period as it deems appropriate to fulfil the stated purposes or as required by law.
In accordance with Data Protection Principle 1(3) under the Personal Data (Privacy) Ordinance (Cap. 486), the Organizer hereby informs visitors that: (a) the supply of personal data is voluntary; however, failure to provide required data may prevent the Organizer from processing registration or providing relevant services; (b) personal data may be transferred to the classes of persons described above; (c) visitors have the right under sections 26 and 22 of the Personal Data (Privacy) Ordinance (Cap. 486) to request access to and correction of their personal data; and (d) requests for access to or correction of personal data should be submitted in writing to: Hong Kong Jewelry Manufacturers' Association, Address: Unit G., 2/F., Kaiser Estate Phase 2, 51 Man Yue Street, Hunghom, Kowloon, Hong Kong, Email: enquiry@jewelry.org.hk.
For direct marketing purposes, the Organizer will obtain visitors' explicit and voluntary consent separately at the time of registration, and will inform visitors of their right to opt out at any time, free of charge, by notifying the Organizer in writing.
These Terms of Use shall be governed by the law of the Hong Kong Special Administrative Region. Visitors agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.
The Organizer reserves the right to modify these Rules and Regulations, Exhibition times, venue arrangements, ticketing policies, etc., at any time. Modifications will take effect immediately upon publication, and visitors are responsible for regularly reviewing the latest terms.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, without affecting the validity and enforceability of the remaining provisions.
The Organizer has the final and absolute right to decide on all operational matters related to the Exhibition (including but not limited to admission eligibility, determination of conduct, and enforcement of rules), and the Organizer's interpretation of these Terms and Conditions shall be final and binding, subject to applicable Hong Kong law.
These Rules and Regulations constitute the entire agreement between the Organizer and the visitor with respect to the Exhibition and supersede all prior representations, negotiations, and agreements. Failure by the Organizer to enforce any provision of these Rules and Regulations shall not constitute a waiver of the Organizer's right to enforce such provision at any time in the future.
If there is any conflict or difference between the Chinese version of the Terms of Use and its English version, the English version prevails. If any part of the Chinese version is unclear, reference should be made to the English version.
